We’re delighted with the ruling from the U.S. Court of Appeals for the Fifth Circuit which vacated the FTC’s order and held that the FTC’s adjudication of its claims, relating to Intuit’s advertising of its free products, before its own administrative law judge violated the U.S. Constitution’s separation of powers.

Intuit has always been clear, fair, and transparent with its customers and we are proud that over the past 12 years, we’ve helped more than 140 million Americans file their taxes for free, more than all other tax preparation software companies combined.

“I’m thrilled that, once this matter returned to a neutral decision-maker, common sense carried the day,” said Kerry McLean, executive vice president and general counsel at Intuit. “From the beginning, we were confident in our case and that, when this matter returned to a neutral body like the Fifth Circuit, Intuit would prevail. Intuit has already spent years defending itself against these meritless claims.”
